Abstract:

Diplomová práce se zabývá právní ochranou výtvarných děl v České republice. Jejím cílem je nejprve definovat co to výtvarné dílo je, kdo je autor a jaká právní úprava se na ně vztahuje. Následně pak zjistit možné postupy využití, tak jako i možné metody zneužití výtvarných děl v České republice. Dále se práce soustředí na způsoby jejich ochrany a v neposlední řadě i poukazuje na to, jaké problémy mohou v rámci této problematiky nastat. Práce je postavená na blízké spolupráci s autorkou řady významných výtvarných děl, jejíž zkušenosti jsou v práci přímo zakomponovány.

Abstract:

The thesis addresses legal protection works of art in the Czech Republic. The main aim of this thesis is to define what is an artwork, who is an author of this artwork and what is an appropriate legal code corresponding to this issue. At the same time the thesis tries to discover possible methods of use and misuse of artworks in the Czech Republic. The thesis also deals with different methods of protection and last but not least points to possible problems concerning this issue. This thesis is based on close cooperation with the author of many significant artworks and her experiences are included directly in the thesis.
