Abstract:

Bakalářská práce na téma: "Společnost a trest historie a současnost" pojednává o trestech a způsobech trestání v průběhu historických epoch až po současnost. Zabývá se otázkou přiměřenosti a adekvátnosti trestů, ochranou jednotlivce i společnosti před kriminálním jednáním. Rovněž zmiňuje působení zločinu a trestu na člověka v současné době, kdy se běžně setkáváme s mnoha formami kriminality, recidivy, nedodržování zákonů i ostatních právních předpisů. Tímto dochází k ohrožení bezpečnosti, k narušování mezilidských vzta-hů, vzniká pocit ohrožení a bezmoci, vytrácí se právní jistoty i víra ve spravedlnost. Poru-šování norem bývá stále častěji společností tolerováno, protože je podporováno nejedno-značností zákonů, soudních rozhodnutí a beztrestností viníků, načež se množí případy vlastní spravedlnosti a nepřiměřené obrany. V této práci budou uvedeny i různorodé názory občanů na trestání i pachatele trestných činů, možnosti trestů a ochranu kvalitního soukromého i společenského života.

Abstract:

Bachelor thesis: "Society and Punishment - History and Present" deals with the penalties and punishment methods during historical epoch to the present. It examines the relevance and adequacy of punishment, protection of the individual and the society from criminal conduct. It also mentions the effects of crime and punishment to humans at present, which is often met with many forms of crime, recidivism, failure to comply with laws and other regulations. This leads to security threats, the disruption of interpersonal relationships, the feeling of danger and helplessness, vanishes legal certainty and faith in justice. Violations of standards is increasingly tolerated in the community because it is supported by the am-biguity of laws, judicial decisions and the impunity of the guilty, then is increasing eviden-ce of their own righteousness and inadequate defense. In this work will be presented as well as the diverse views of citizens and to punish offen-ders, sentencing options and high quality protection of private and social life.
