The Legal Mode of Buildings on Foreign Land

Abstract:

Tato práce je věnována problematice právního režimu staveb na cizím pozemku. V závislosti na tom, zda vlastníkovi stavby svědčí občanskoprávní titul ve vztahu k vlastníkovi pozemku, je pak osvětlena nejprve historickou genezí právního institutu práva stavby v českých zemích. Tímto institutem byly upraveny právní vztahy mezi vlastníkem pozemku a osobou oprávněnou k provedení stavby na něm, při jinak traktované obecné zásadě superficies solo cedit za účinnosti obecného zákoníku občanského z roku 1811, tedy že stavba je součástí pozemku, kterou pak střední zákoník občanský z roku 1950 opustil, když zavedl zásadu opačnou, jejímž důsledkem byl a je doposud v zákoně č. 40/1964 Sb., občanském zákoníku, ve znění pozdějších předpisů, upraven samostatný režim pozemku a staveb na pozemku vzešlých. Aktuálnost a zároveň složitost dané problematiky se autorka snaží přiblížit především ve světle judikatury prezentované soudy České republiky. Závěrem vyjádří autorka názor, že je žádoucí, aby byl důsledněji propracován právní režim ke stavbám na cizím pozemku, když stávající právní úprava toliko řeší již jen důsledky toho, že někdo zřídí bez občanskoprávního titulu stavbu na cizím pozemku.

Abstract:

The thesis deals with issues concerning the legal mode of buildings on foreign land. The genesis of legal institute of building right in Czech countries is explained in dependency on whether the building owner has the civil title in relation to the land owner or not. This institute was applied to legal relationships between the land owner and the man entitled to implement the building on it, applying the general “superficies solo cedit” principle according to the Civil Code of 1811 being forced. That meant the building was a part of the land. The Common Civil code of 1950 left this principle, when it implemented the opposite principle, which is applied to the independent mode of the land and the buildings on it in the Act No. 40/1964 Coll, the Civil Code, as amended, being in force. The author is trying to explain the recency and the complexity of these problems, mainly in connection with the judicature presented by the courts of the Czech Republic. In the final part of the thesis the author expresses the opinion, that there is the need to elaborate the legal mode concerning the buildings on foreign land, because the present legal regulations concern just the effects of establishing a building on a foreign land without a civil title.
