Autonomy of Will in Labour Relations

Abstract:

Tato diplomová práce vymezuje zásadu autonomie vůle v kontextu odvětví pracovního práva. Práce analyzuje uplatnění této zásady v mezích pracovněprávních zásad a v základních funkcích pracovního práva. Vedle základního vymezení této zásady se práce zabývá faktickými a právními limity této zásady v pracovněprávních vztazích, přičemž na konkrétních institutech demonstruje omezení, která jsou na tuto zásadu kladena v rámci individuálních a kolektivních pracovněprávních vztahů. Vhodnost regulace je také průběžně hodnocena. V závěru práce následuje zvážení nutnosti regulace a omezení autonomie vůle.

Abstract:

The diploma thesis deals with the principle of autonomy of will in the context of labour law. The thesis analyses the use of this principle within the limits of labour principles and within the basic functions of labour law. Besides the basic definition of the principle, the thesis deals with factual and legal limits of this principle in labour relations and demonstrates limits which apply for the use of this principle within individual and collective labour relations. The appropriateness of regulation is also continually evaluated. The consideration of necessity of regulation and of the limits of autonomy of will is provided in the end of the thesis.
