The Right to Complete a Blank Bill of Exchange

Abstract:

Využití blankosměnky v české právní praxi je v současné době velice rozšířené. Zejména finanční instituce uplatňují své fakticky nadřazené postavení v právním vztahu a poskytnutí úvěru často podmiňují jeho zajištěním právě emisí blankosměnky. Pro rozšíření právního vědomí se tato diplomová práce zabývá jednotlivými aspekty samotného institutu blankosměnky, především jejím nejvýznamnějším pojmovým znakem, právem na její doplnění. Diplomová práce poukazuje na problematické stránky vyplňovacího oprávnění, a jaké následky mohou nastat, pokud účastníci přistoupili k uzavření dohody o udělení práva k vyplnění směnečného blanka nedůsledně.

Abstract:

The use of blank bills of exchange in Czech legal practice has become increasingly widespread. In particular, financial institutions have been recently asserting their factually superior position within legal relationship and drawing up drafts of security blank bills of exchange as a condition for providing a loan. To facilitace further legal awareness, this thesis focuses on individual aspects of a blank bill of exchange, especially the right to complete it, which is the most important conceptual characteristic of a blank bill of exchange. This thesis will outline various problematic aspects related to the completion of a blank bill of exchange. More specifically, it will discuss the different repercussions that may ensure if the parties to an agreement were not consistent prior to entering into an agreement regarding the bestowal of the right to complete the blank bill of exchange.
