Confidentiality of Mediation

Abstract:

Tato diplomová práce se zabývá problematikou mlčenlivosti v mediaci, která je jedním z projevů principu důvěrnosti a která slouží k zajištění důvěrného prostředí během mediace a k ochraně poskytnutých důvěrných informací. Práce se nejprve zaměřuje na obecné vymezení principu důvěrnosti a na právní úpravu mlčenlivosti v mediaci. Následně práce analyzuje současnou právní úpravu mlčenlivosti v mediaci a možnosti jejího zajištění včetně odpovědnosti a sankcí za porušení mlčenlivosti. V závěru je poukázáno na zjištěné nedostatky a je navržen možný budoucí vývoj právní úpravy.

Abstract:

This diploma thesis deals with the issue of confidentiality in mediation which is one of the manifestations of the principle of confidentiality and which serves to ensure a confidential environment during mediation. Firstly, the thesis focuses on the general definition of the confidentiality principle and the legal regulation of confidentiality in mediation. Subsequently, the thesis analyses the current legal regulation of confidentiality in mediation and the possibilities of ensuring it, including liability and sanctions. The last chapter offers the solution for some of the identified problems.
