Alternative Dispute Resolution in Consumer Credit

Abstract:

Cílem bakalářské práce „Alternativní řešení sporů u spotřebitelských úvěrů (Alternative Dispute Resolution in Consumer Credit)“ je předložení uceleného přehledu možností alternativního řešení sporů u spotřebitelských úvěrů. Práce se zaměřuje na základní prvky, které mají vliv na podobu samotného vztahu mezi věřitelem a spotřebitelem. Současně předkládá ucelený náhled na průběh řízení před Finančním arbitrem. Autor se v první podkapitole obecné části zabývá systémy ADR. V druhé podkapitole se věnuje spotřebitelskému úvěru a zásadám jeho poskytování od roku 2011. V první podkapitole zvláštní části se věnuje základním prvkům závazkových vztahů. Druhou podkapitolu této části tvoří představení pojmu Finančního arbitra. Představuje jeho poslání, kompetence a úkoly spojené s výkonem jeho funkce. A zabývá se zde průběhem řízení před Finančním arbitrem od podání návrhu v písemné formě nebo prostřednictvím on-line průvodce až po způsoby rozhodnutí. V závěrečné podkapitole této části se krátce věnuje rozhodování sporů ze spotřebitelských úvěrů rozhodci v rámci rozhodčího řízení.

Abstract:

The goal of the bachelor thesis Alternative Dispute Resolution in Consumer Credit is the submitting of a complete overview of possibilities of alternative dispute resolutions in the case of consumer credit. The work is focused on the basic points that are important for such a type of the relationship between a creditor and a debtor. It also shows a complete overview of the Financial Arbitrator the procedure. In the first subchapter of the general part the author deals with the systems of ADR. In the other subchapter the author deals with a consumer’s credit and principles if its supply as used from 2011. In the first subchapter of the other part the author deals with the basic components of obligation relationships. The second subchapter is focused on the introduction of the term „Financial arbitrator“. Its function, competence and related tasks are explained. It also deals with the Financial arbitration process from submission of the application in writing or through the on-line guide to the ways of resolutions. In the final chapter of this part the author briefly deals with resolutions of disputes from consumer credit in the arbitration.
