Law and music: Interpretation and improvisation – a comparative study

Abstract:

Tato rigorózní práce se zaměřuje na vzájemná propojení mezi právem a hudbou, zejména v oblasti jejich interpretačních procesů. Ukazuje základní podobnosti mezi oběma disciplínami a zabývá se otázkou, jak může být práce právního interpreta inspirující pro interpreta hudebního a naopak. Přestože jde o teoreticky zaměřenou práci, není omezena pouze na hodnocení dostupných interpretačních doktrín, ale snaží se poukázat i na ostatní vlivy povahy subjektivní i objektivní, které se zasluhují o výsledný produkt interpretace. Práce se také snaží najít a popsat základní schéma komparace podobností mezi interpretacemi v obou disciplínách, vytyčit hranici mezi interpretací a improvizací a ukázat, že ani v hudbě, ani v právu, improvizace neznamená neomezenou libovůli, nýbrž má vlastní poměrně striktní pravidla, které je nutno dodržovat, a která stojí za prozkoumání pro dosažení hlubšího porozumění problematiky interpretace a pochopení procesu, kterým interpreti skutečně procházejí.

Abstract:

This doctoral thesis aims on the interconnection of law and music, especially on interpretive process performed in both. It shows basic similarities between these two areas of human activities and focuses on the question how the work of legal interpreters can be inspirational for the musical interpreters and vice versa. Although it is a theoretical publication, it doesn’t limits its goals just to show which doctrines are available for interpreters, but also tries to explore other objective and subjective factors, which have large impact on the final interpretation. It also tries to find and define, in this basic comparative example of interpretive similarities, the line between interpretation and improvisation and shows that neither in music, neither in law it is unlimited arbitrariness, but that it has its own rules worth exploring for deeper understanding what really the interpreters do.
