Abstract:

Tématem této bakalářské práce je právní úprava držby a vlastnictví. První část vymezuje základní pojmy vlastnického práva. Vlastnické právo je zde rozebráno a charakterizováno hlavně z obecného hlediska, značná část textu se věnuje jeho jednotlivým znakům a především jeho vymezení. Další část práce se pak věnuje historickému vývoji držby a vlastnictví, kde lze shledat, že právo, jak ho známe dnes, z této historie vychází. Tato kapitola rovněž poukazuje na to, jak snadno lze právo zneužít a zmiňuje momenty v naší nedávné historii, kdy právě k tomuto zneužití došlo a je důležité mít tuto hrozbu na vědomí. Třetí část podrobně analyzuje institut držby a vlastnictví v přímé souvislosti s dnešní platnou právní úpravou. Poslední, praktická část je zaměřena na komparaci stávající a dřívější právní úpravy, kde jsou vymezeny stěžejní rozdíly ve zmíněných úpravách, co se institutů držby a vlastnictví týče. Podrobně je zde rozebráno nabývání vlastnického práva od nevlastníka, neboli rovněž od neoprávněného.

Abstract:

The theme of this thesis is legislation of the tenure and the ownership. The first part defines the basic concepts of rights of ownership. The rights of ownership are analyzed and characterized mainly in general terms. A considerable part of the text is devoted to individual characters and especially the definition of rights of ownership. The next part is devoted to the historical development of tenure and ownership, where you can find that right that we know in current form is based on this history. This chapter also points out how easy it is to abuse the law. It also mentions moments in our recent history when just such abuse has occurred and it is important to note this menace. The third part provides a detailed analysis of institute of tenure and ownership in direct connection with the current legislation. Last part which is practical is focused on a comparison of current and previous legislation. There are mentioned major differences in this legislation. This part also analyzes in detail the acquisition of ownership rights from non-owner.
