Abstract:

Tato bakalářská práce pojednává o historickém vývoji lidských práv až po současnost. Vymezuje základní pojmy, jako jsou lidská práva, Listina základních práv a svobod, tuzemské i zahraniční orgány a organizace zabývající se lidskými právy. Kategorizace lidských práv jako - osobní práva a svobody, politická práva, nová práva, sociální, hospodářská a kulturní práva, práva národnostních a etnických menšin a neopomenutelné právo na soudní a jinou ochranu. Také zde nalezneme vymezení postihů v případě porušování lidských práv. A kde je vlastně možné, domáhat se spravedlivé nápravy při jejich porušování. Další obsáhlou částí této práce je také charakteristika institutu Veřejného ochránce práv neboli ombudsmana. Je zde historické nastínění vzniku této instituce. Dále pak jak je jmenován do funkce, jak je odvolán z funkce, jak dlouhé je jeho funkční období, jaké jsou jeho pravomoci a s tím související povinnosti, ale také postihy. Nalezneme zde také srovnání institutu českého a evropského ombudsmana.

Abstract:

This bachelor thesis concerns about historical development of human rights up to now. It defines the basic terms as human rights, Declaration of human rights, home and foreign organizations occupied with human rights; Categorization of human rights as personal rights and freedom, politician rights, new rights, social, economy and cultural rights, rights of national and ethnical minorities and entitlement to judicial and other preservations. We can find here the specification of sanctions in case of breaking the human rights, and where we can seek requitable remedies in case of breaking them, too. The next part of this bachelor thesis is about the characteristic of the institute of Public protector of rights – Ombudsman. There is the historical outline of establishment of this institute, how to appoint or remove him from office, term of office, his rights and responsibilities related to his function and sanctions. We can find here the comparasion of the institute of czech and european ombudsman, too.
