Legal Aspects of the Doctor – Patient Relationship

Abstract:

Diplomová práce Právní aspekty vztahu lékař -- pacient se zabývá právní úpravou nejdůležitějších otázek medicínského práva, mezi které řadí péči lege artis, informovaný souhlas, hospitalizaci a poskytování zdravotní péče bez souhlasu pacienta a negativní revers. Cílem této práce je určení odlišností mezi předešlou a současnou právní úpravou výše uvedených základních principů a právních nástrojů, které jsou v právní rovině aplikovány při poskytování zdravotní péče. Mezi základní metody této především teoretické práce patří analýza-syntéza, komparace a analogie. Takový metodologický přístup umožňuje pochopit, z čeho nová legislativa vychází, jaký má vztah k předchozím zákonným předpisům, jaké jsou její jednotlivé prvky, jaký je její přesah do praxe a eventuálně zdali existuje podobnost české legislativy se zahraniční právní úpravou. Hlavní část práce tvoří postupné představení a rozbor problematiky informovaného souhlasu, hospitalizace a poskytování zdravotní péče bez souhlasu pacienta a negativního reversu. Otázka změn v právní úpravě je soustředěna především na dopady zákona č. 89/2012 Sb., občanského zákoníku a zákona č. 372/2012 Sb., o zdravotních službách a podmínkách jejich poskytování. To umožňuje pochopit změny, které tyto předpisy do systému poskytování zdravotní péče přinášejí, a ozřejmit problémy, na které současná legislativa reaguje. Druhou část práce tvoří představení širších souvislostí medicínského práva, ze kterých současná legislativa vychází: princip lege artis, základní otázky etiky v medicíně, historický vývoj právní úpravy poskytování zdravotní péče v České republice a komparaci české právní úpravy zpracovaných témat s odpovídající úpravou ve vybraných státech. Práce je doplněna postřehy a kazuistikami z praxe, jejichž cílem je lepší zpřístupnění problematiky čtenářovi.

Abstract:

The thesis "Legal Aspects of the Doctor -- Patient Relationship" deals with the legislation of most important issues in medical law. Among those are included lege artis medical treatment, informed consent, providing hospitalization and medical treatment without informed consent and refusal of medical treatment. The aim of the thesis is to determine what are the differences between antecedent and current legislation of several main legal principles and legal instruments used when providing medical treatment. Among main methods of this theoretical thesis are analysis-synthesis, comparation and analogy. This methodological approach allows understanding of the grounds on which the legislation is estabilished, what is its relationship with the antecedent legal acts, what are its main elements, how does it translate to everyday practice and eventually, whether there exists any analogy between Czech and foreign legislation in this field. The main body of the thesis contains of successive presentation and analysis of the informed consent, providing hospitalization and medical treatment without informed consent and refusal of medical treatment. The issue of legal changes and amendments concentrates particularly on the effects of the Czech legal act No. 89/2012, "občanský zákoník" (Civil Code) and the Czech legal act No. 372/2012, "o zdravotních službách a podmínkách jejich poskytování" (Health Care Services and the Terms of their Provision). This allows the reader to understand the effects of these health care legal acts and to clarify the challenges to which current legislation reacts. The second part of the thesis deals with broader aspects of medical law which affect current legislation, such as: lege artis medical treatment, fundamental ethical issues in medicine, historical development of health care legislation in the Czech republic and the comparison of Czech legislation of the above mentioned topics with the appropriate legislation in selected countries. The thesis includes observations and cases from a practical point of view to allow better understanding of the field.
