The meaning and role of mens rea in criminal law

Abstract:

Hlavním cílem této diplomové práce je rozebrat problematiku lhostejnosti v rámci jednotlivých forem zavinění i z pohledu psychologie, psychiatrie a sociologie. Vysvětlit, proč je důležité se na subjektivní stránku trestného činu dívat z hledisek několika různých oborů, a přiblížit složitost zkoumání psychiky pachatele ve vztahu k trestněprávnímu jednání. K rozboru této problematiky z právního hlediska byla použita případová studie judikatury související s lhostejnými pachateli trestných činů a závěry z ní vyplývající byly porovnány s úpravou lhostejnosti v současné úpravě našeho trestního práva. Největší pozornost byla věnována posouzení míry společenské škodlivosti lhostejnosti a správnosti jejího zařazení v rámci trestního zákoníku.

Abstract:

The primary purpose of this diploma thesis is to analyse the issue of indifference within individual forms of mens rea, together with the view of psychology, psychiatry and sociology on this matter. It is explained why it is important to look at the subjective aspect of the crime from the perspective of several different disciplines. We also explore the complexity of examining the perpetrator's psyche in relation to criminal behaviour. A case study of the case law related to indifferent offenders was used to analyse this issue from a legal point of view. The conclusions drawn from the study were compared with the modification of indifference in the current regulation of our criminal law. The greatest attention was paid to assessing the degree of social harm done by indifference and the correctness of its inclusion in the Criminal Code.
