Interpretation of the conditions for admission the right to tax deduct

Abstract:

Rigorózní práce „Výklad podmínek pro přiznání nároku na odpočet daně“ se zaměřuje na problematiku prokazování nároku na odpočet daně a s tím souvisejících podmínek. Jelikož je daň z přidané hodnoty daní harmonizovanou v rámci Evropské unie, bude v této práci kladen důraz na komunitární a tuzemskou úpravu a její výklad v rámci rozhodovací praxe Soudního dvora Evropské unie a tuzemských správních soudů v čele s Nejvyšším správním soudem. Předmětem práce bude ověření hypotézy, zda je výklad podmínek nároku na odpočet daně ze strany tuzemských správních soudů souladný s výkladem těchto podmínek ze strany Soudního dvora Evropské unie. V případě, že nikoliv, bude ověřována další hypotéza, zda by za situace, pokud by tuzemské správní soudy přistoupily na eurokonformní výklad, nebylo ohroženo ze strany České republiky naplňování cílů Směrnice Rady.

Abstract:

The rigorous thesis „Interpretation of the conditions for admission the right to tax deduct“ is focused on the issue of proving the right to tax deduct and the associated conditions. Since the value added tax is a harmonized tax within the European Union, this thesis will focus on the community and domestic legislation and its interpretation in the context of decisions of the Court of Justice of the European Union and domestic administrative courts headed by the Supreme Administrative Court. The subject of the thesis will be the verification of the hypothesis whether the interpretation of the conditions for the right of tax deduct by the domestic administrative courts is consistent with the interpretation of these conditions by The Court of Justice of the European Union. If not, a further hypothesis will be examined whether, if the domestic administrative courts approached the Euroconform interpretation, the Czech Republic did not endanger the fulfillment of the objectives of the Council Directive.
