Termination of Employment on the Basis of Unilateral Legal Transactions

Abstract:

Bakalářská práce shrnuje současnou českou právní úpravu v oblasti pracovního práva, konkrétně v části upravující jednostranná právní jednání vedoucí k rozvázání pracovního poměru, přičemž tato dále uvádí v kontextu relevantních judikátů, které ukotvují současný výklad této právní úpravy. Další částí práce je komparace, respektive nadnesení řešení této problematiky v kontextu německé právní úpravy, se zaměřením na rozdíly mezi českou a německou úpravou. Autor práce v jejím závěru pak po srovnání obou právních úprav vyslovuje názor, že obě jsou v současné podobě funkční, a to i přes jejich vzájemné dílčí rozdílnosti, přičemž je zároveň přesvědčen, že zjištěné rozdílnosti mohou přispět do diskuse de lege ferenda.

Abstract:

The bachelor thesis summarizes the current Czech legislation in the field of labor law, specifically in the section regulating unilateral legal acts leading to termination of employment, which in the context of relevant judgments, which anchor the current interpretation of this legislation. Another part of the thesis is a comparison, or more precisely, a solution of this issue in the context of the German legislation, with a focus on the differences between the Czech and German regulations. At the end of the thesis, the author of the thesis, after comparing the two legal regulations, expresses the view that both of them are functional in their current form, despite their mutual partial differences, while also being convinced that the differences identified can contribute to the de lege ferenda debate.
