Penalties according to the Criminal Code

Abstract:

Bakalářská práce "Tresty dle trestního zákoníku" se zaměřuje na způsob trestání trestné činnosti v České republice. Nejprve jsou definovány základní pojmy týkající se sankcionování a celkový proces trestního řízení, dále jsou vymezeny všechny tresty, které lze v České republice uložit. Druhá polovina práce poté pojednává o vykonávacím řízení, jaký je průběh výkonu trestu a následně přichází přesun k poslední části práce, kterou je zaměření se na konkrétní trest, kterým je trest domácího vězení. Práce se zaměřuje především na zodpovězení výzkumných otázek, zda je trest domácího vězení do budoucna perspektivním trestem, zda je dostatečně zabezpečován a jak účinný je v porovnání s ostatními tresty. Dále také pojednání o tom, zda tresty obecně v jsou v naší zemi dostatečným nástrojem proti páchání trestné činnosti. V závěru přichází zodpovězení výzkumných otázek a zhodnocení dosažení předem stanoveného cíle.

Abstract:

The bachelor thesis "Penalties according to the Criminal Code" focuses on the method of punishing crime in the Czech Republic. First, the basic terms related to sanctions and the overall process of criminal proceedings are defined, then all the penalties that can be imposed in the Czech Republic are defined. The second half of the work then discusses the enforcement proceeding, what is the course of the execution of the sentence and then comes the move to the last part of the work, which is to focus on a specific sentence, which is a house arrest. The work focuses mainly on answering research questions, whether the sentence of house arrest is a perspective sentence in the future, whether it is sufficiently secured and how effective it is in comparison with other sentences. Furthermore, a discussion of whether punishment in general are a sufficient tool against crime in our country. In the end there is an answer to the research questions and an evaluation of the achievement of a predetermined goal.
