Legal regulation of the state administration in Czech Republic

Abstract:

Diplomová práce je zaměřena na právní úpravu státní služby, tedy zaměřením na službu státních zaměstnanců. V práci ovšem chci popsat i další vztahy státu X občana (osoby zaměstnané), od zaměstnaneckého poměru, až po služební poměr příslušníka bezpečnostního sboru nebo vojáka z povolání. Úvodní část bude zaměřena na vývoj právní úpravy a dále pak komparací jednotlivých služebních poměrů. Posléze je popsán již zákon o státní službě, tedy zejména vysvětlení pojmu státní služba, systemizace, a další části zákona. V kapitole obecné principy státní služby, se práce věnuje myšlence, proč vůbec státy státní službu regulují. Obecnými principy rozumíme odpolitizování, profesionalizace a určitá předvídatelnost, otevřenost výkonu práce pro stát, ve prospěch státu, jeho veřejného zájmu a ve prospěch občanů. Součástí diplomové práce je rozsah působnosti služebního zákona, jeho základní ustanovení. Následně bude zpracována organizace státní služby, jako je např. hierarchie státních orgánů a státních zaměstnanců. V další části práce se zaobíráme služebními předpisy. Služební předpisy jsou oprávněni vydávat náměstek pro státní službu, vedoucí služebního úřadu nebo státní tajemník. Jde o předpisy, které upravují organizační věci služby. V neposlední řadě je práce zaměřena na současné návrhy změny právní úpravy a též na praktická doporučení. Cílem této diplomové práce je zejména vymezení základních pojmů a nástrojů spojených se služebním zákonem, a jeho aplikaci ve služebních úřadech.

Abstract:

The focus of the thesis is the legal regulation of civil service, thus focusing on the service of civil servants. In my thesis, I also want to describe other relationships of the state versus citizens (employed people), from an employment relationship to the service of a security officer or a professional soldier. The introductory part is focused on the development of legislation and next on a comparison of the individual service relations. Then the law of civil service is described such as an explanation of the concept of civil service, systemization and other parts of the law. In the chapter “General principles of civil service” the thesis is focused on an idea „why states (governments) regulate the civil service in general.“ The general principles are understood as de-politicization, professionalism and certain predictability, openness to work for the state, for the benefit of the state, its public interest and citizens benefit. Part of the diploma thesis is the scope of service law, its basic establishment. The organization of the civil service, such as the hierarchy of state authorities and civil servants, is processed subsequently. In the next part of the thesis we deal with service regulations. The service regulations are authorized to emit the deputy minister for the civil service, the head of the civil office or state secretary. These are rules that regulate the organizational matters of the service. Last but not least, the thesis is focused on current proposals of changes in legislation and also practical recommendations. The objective of the thesis is to define the basic concepts and instruments bound up with the Service Act and application of the Act in the service offices.
