Culpability

Abstract:

Tato bakalářská práce se zaměřuje na zavinění v trestním právu. Pojednává o jeho obecném vymezení, popisuje základní pojmy a rozebírá historický vývoj zavinění v českém trestním právu od roku 1852 po současnost. Také se okrajově zabývá trestným činem a jeho znaky. Věnuje se formám zavinění, tj. úmyslu a nedbalosti. Cílem práce je detailněji analyzovat obě formy zavinění, porovnat je a zhodnotit jejich význam v rámci trestního práva. V poslední kapitole se tato práce zabývá vybranými problémy zavinění, jako je zavinění bílých koní a dokazování samotného zavinění.

Abstract:

This bachelor's thesis focuses on culpability in criminal law. It deals with its general definition, describes basic concepts, and analyzes the historical development of culpability in Czech criminal law from 1852 to the present. It also briefly discusses the criminal act and its characteristics. The thesis examines forms of culpability, i.e., intent and negligence. The aim of the thesis is to analyze both forms of culpability in detail, compare them, and evaluate their significance within criminal law. In the final chapter, this thesis addresses selected issues of culpability, such as the culpability of "white horses" and the proof of culpability itself.
