Torture and other Inhuman, Cruel or Degrading Treatment and Punishment within the Prison System

Abstract:

Téma mučení a jiného nelidského, krutého či ponižujícího zacházení a trestání zaměřující se na oblast vězeňství je odbornou literaturou částečně opomíjeno. Ačkoliv je právní úprava v této oblasti v souladu s požadavky na zákaz mučení a jiného nelidského, krutého a ponižujícího zacházení a trestání, domnívám se, že praxe s ní plně nekoresponduje. Zaměřuji se proto na problémy v oblasti vězeňství, které souvisí s porušením tohoto zákazu a na možnosti odsouzeného domoci se svých práv. Cílem mé práce je tedy poukázat na tyto problémy, zmapovat je a pochopit, v čem spočívají.

Abstract:

The issue of torture and other inhuman, cruel or degrading treatment and punishment, focused on the prison system is still partially neglected by the professional literature. Even though the legislation in this area is in obedience to the requirements for the prohibition of torture and other inhuman, cruel and degrading treatment and punishment, I believe that the practice does not fully correspond with it. That is the reason why I concentrate on the problems in the prison system, which is related to the violation of this prohibition and on the possibility of the convict to regain their rights. The objective of my thesis is to point out these problems, to map them and understand what they are consisting of.
