Anglo-American Legal System

Abstract:

Tato práce pojednává o angloamerickém právním systému, který je vedle kontinentálního právního systému druhým nejrozšířenějším na světě. Práce si neklade ze cíl zmapovat všechny oblasti, odvětví a instituty angloamerického práva, spíše se snaží tento systém představit v jeho odlišnostech ke kontinentálnímu systému a pojednat o těch jeho rysech, která jsou pro něj charakteristické a osobité. I když je tento právní systém rozšířen více či méně v mnoha zemích světa, práce se soustřeďuje především na právo anglické, které je v tomto systému původní a ostatní subsystémy z něj byly vytvořeny cestou britské kolonizace. Jádro práce tvoří pět kapitol, ve kterých se popisuje charakter, struktura a prameny anglického práva, soustava anglických soudů a instituty procesního práva. Poslední kapitola přináší exkurs do práva USA jako druhého základního subsystému angloamerického práva. Cílem práce bylo nalézt a vyzdvihnout nejvýraznější odlišnosti od českého práva, u kterých by mělo začít studium všech zájemců o tento právní systém.

Abstract:

This dissertation deals with the Anglo-American legal system, which is the second largest legal system in the world, next to the Continental legal system. The dissertation does not aim to analyse all areas, branches and institutions of the Anglo-American law. It tends to introduce the main differences of this system from the Continental law and deal with the features which are typical for it. Although this system is spread to many countries of the world, the dissertation concentrates first of all on the English law, which is original in this system and other subsystems were created in the way of British colonisation. The core of the dissertation is created by five chapters, where the nature, structure and sources of the English law are described, as well as the system of English courts and institutions of procedural law. The last chapter brings an excursion to the law of the USA as the second fundamental subsystem of the Anglo-American law. The aim of the dissertation was to find and point out the most significant differences from the Czech law.
