Abstract:

Tato bakalářská práce se zabývala konceptem restorativní justice, která se v současné době dostává stále více do popředí zájmu odborné, ale i laické veřejnosti. Jejím cílem bylo definovat paradigmata retributivní a restorativní justice, charakterizovat probační a mediační službu a vymezit principy alternativních trestů. Práce byla zpracována do dvou stěžejních částí, a to do části teoretické a části empirické. Teoretická část práce se po krátkém nahlédnutí do historie trestu a vymezení retributivní justice, zabývá především paradigmatem restorativní justice a jejími programy, dále činností a hlavními úkoly probační a mediační služby či alternativními opatřeními. Empirická část této práce porovnávala dvě entity vojáků z povolání, a to vysokoškolsky vzdělané vojáky na straně jedné a středoškolsky či vyučené vojáky na straně druhé. Cílem tohoto průzkumu, který zahrnoval celkem 60 respondentů, bylo zjistit a porovnat informovanost výše uvedených entit o existenci a činnosti probační a mediační služby. Průzkum probíhal prostřednictvím polostrukturovaného rozhovoru, kde bylo každému respondentovi položeno 10 otázek. Výsledky tohoto průzkumu poukazovaly na to, že informovanost vysokoškolsky vzdělaných vojáků z povolání o existenci a činnosti probační a mediační služby, je na vyšší úrovni, než u vojáků středoškolsky vzdělanými či vyučenými. Průzkum tedy potvrdil předem stanovené hypotézy.

Abstract:

This thesis dealt with the concept of restorative justice, which is currently getting more and more into the forefront of expert and amateur public. Its aim was to define the paradigm of retributive and restorative justice, to characterize the probation and mediation servise and define the principles of alternative sentencing. The work was compiled into two main parts, namely in the theoretical and the empirical. The theoretical part of the paper, after a brief insight into the history of punishment and the definition of retributive justice, mainly engaged in the paradigm of restorative justice and its programs, activities and main tasks of the probation and mediation servise or alternative measures. The empirical part of this study compared two entities soldiers, university educated soldiers on one side and high school or apprentice soldiers on the other. The aim of this survey, which included a total of 60 respondets, was to determine and compare awareness of above entities of the existence and activities of the probation and mediation service. The survey was conducted using a structured interview where each respondent was asked 10 targeted questions. The results of this survey pointed out that awareness of university educated professional soldiers of the existence and activities of the probation and mediation service is at a higher level than the soldiers who studied only high school. The survey thus confirmed predetermined hypotheses.
