Fair Trial and its Guarantee in Czech Criminal Proceedings
Abstract:
Bakalářská práce se zabývá právem na spravedlivý proces, jak je definováno Evropskou úmluvou o lidských právech a základních svobodách a vykládáno judikaturou Evropského soudu pro lidská práva. Zkoumá, jak jsou požadavky Evropské úmluvy garantovány v českém trestním řízení, kde jsou slabiny a kde možnosti ke zlepšení. Dále si všímá rozhodovací praxe českých soudů vzhledem k požadavkům Úmluvy.
Abstract:
This bachelor thesis deals with the content of the right to a fair trial as set by the European Convention on Human Rights and Fundamental Freedoms and case law of the European Court of Human Rights. It examines the concept of a fair trial in the sources of national criminal procedure and looks for its weak points and possible improvements.
