Crime Scene Search

Abstract:

Tato diplomová práce se zabývá prohlídkou místa trestného činu, zejména skrze problematiku její výstupů použitelných v trestním řízení. Úvodní část je věnována vymezení základních pojmů souvisejících s tématem a pojednání o dokazování s důrazem na druh a význam pro-hlídek z pohledu dokazování. Jádro této práce tvoří třetí kapitola, která se zabývá samotnou prohlídkou místa trestného činu, ve vztahu k jejím cílům a účelům, přípravě, metodice, taktice vlastního provedení, spolu s uvedením některých specifik v případě prohlídky místa činu násilné trestné činnosti a prohlídky mrtvoly. V této části práce bude rozebrána také problematika zajišťovaní stop v rámci prohlídky a její dokumenta-ce. Závěr této práce je věnován odstranitelným a neodstranitelným va-dám vyskytujícím se při prohlídce. Cílem této práce je zamyslet se nad otázkou, jak postupovat v případě, že prohlídka trpí určitými vadami.

Abstract:

This diploma thesis deals with the crime scene search, especially through the issue of its outputs applicable in criminal proceedings. In the introductory part, it defines the basic terms and the context related to the topic and the treatise on the evidence proceeding with an em-phasis on the type and importance of the search from the perspective of evidence proceeding. The body of this thesis is the third chapter, which deals with the crime scene search itself in relation to its aims and pur-poses, preparation, methodology and tactics of self-execution, together with some specifics in case of crime scene search of violent crime and post-mortem examination. In this part of the thesis will be also dis-cussed the issue of collecting evidences within the search and its doc-umentation. The last part of this thesis is devoted to removable and irremovable defects occurring during the search. The aim of this thesis is to reflect on the question of how to proceed if the search suffers from certain defects.
