Working Conditions of Temporary Employees

Abstract:

Tato diplomová práce se zabývá pracovními podmínkami agenturních zaměstnanců, zejména jejich rozborem a vymezením povinností agentur práce a uživatele při jejich zajištění. Přínosnost práce spatřuji především ve vymezení problémů, které vznikají v rámci agenturního zaměstnávání, a to nejen při zprostředkovávání zaměstnání v rámci naší republiky. Okrajově jsou nastíněny i problémy, které vznikají v souvislosti s vysíláním pracovníků do zahraničí. Práce je členěna do pěti kapitol, přičemž v první kapitole je charakterizována agentura práce jako právní pojem a je zde pojednáno také vymezení dočasného přidělení agenturního zaměstnance k uživateli. Druhá kapitola nastiňuje podmínky, které musí být splněny, aby fyzická či právnická osoba mohla agenturu práce legálně založit a vstoupit tak na trh práce. Třetí kapitola podává přehled o nejdůležitějších mezinárodních pramenech v oblasti agenturního zaměstnávání. Čtvrtá kapitola je stěžejní kapitolou celé mé práce, jsou v ní podrobně rozvedeny pracovní a mzdové podmínky agenturních zaměstnanců spolu s povinnostmi, které musí být jak agenturou práce, tak uživatelem dodržovány. Poslední kapitola se věnuje ochraně agenturního zaměstnance při nedodržování povinností, které agentuře práce a uživateli stanovuje zákon, a možnostmi náhrady škody.

Abstract:

This thesis deals with working conditions Agency Work-ers, especially the analysis and definition of the duties of temporary work agencies and users during their detention. The contribution of this work I see particularly in defining the problems that arise in the context of temporary agency work and not only in mediating employment within our country, but they are marginally outlined the issues that arise in the context of posting workers abroad. The work is divided into five chapters, the first chapter is defined by the employment agency as a legal concept and definition of agency employees tempo-rary assignment to the user. The second chapter discusses the conditions which must be satisfied in order for a natural or legal person can work legally establish an agency and thus enter the labor market. The third chapter gives an overview of the most important international sources of agency employment. The fourth chapter is the main chapter of my entire work, as it details the working and salary conditions of agency workers with the obligations that must be both an employment agency and user compliance. The last chapter is devoted to the protection of agency staff in its obligations, the Agency works and the users of the law stipulates a possibility of compensation
