Contribution to Care – Claim Conditions, Procedure

Abstract:

V úvodu předložené práce jsem se zabývala sociálními službami v České republice, jejich charakteristikou a cíli. V následující části jsem věnovala pozornost rozdělení sociálních služeb a dávkám pro osoby se zdravotním postižením, kam je také zařazen příspěvek na péči. Především jsem se soustředila na podmínky vzniku nároku na dávku, určila orgány, které rozhodují o této dávce a podrobně rozebrala průběh řízení o dávku, tedy zahájení řízení, proces posuzování žádosti, rozhodnutí o dávce, včetně opravných prostředků. Ve své práci jsem uvedla jak příklady z praxe, tak judikaturu Nejvyššího správního soudu. V celé práci a především v jejím závěru jsou zařazeny tabulky a grafy se statistickými údaji, které sledují vývoj vyplácení příspěvku na péči, množství provedených posudků či poměr jednotlivých přiznaných stupňů závislosti. V samém závěru práce jsem zhodnotila význam této dávky a také probíhající sociální reformy.

Abstract:

In the introduction of the thesis, I dealt with the problem of social services in the Czech Republic, their characteristics and goals. In the following part I paid attention to the distribution of social services and allowances for people with handicaps, among which the contribution to care belongs. I primarily concentrated to the conditions of the development of the claim to an allowance, then I defined authorities which decide about the allowance, and I analysed in detail the progress of the procedure of allowances that implies the initiation of the procedure, the process of assessment of the request, and the decision about the allowance, including correction means. In the thesis I mentioned both examples from my experience and practice of The Supreme Administrative Court. In the whole thesis and especially in the end, there are tables and graphs with statistic entries monitoring the development of the disbursing of the contribution to care, the amount of executed assessments, and ratio of particular recognized degrees of dependence. In the very end of the thesis I evaluated the importance of this allowance as well as the ongoing social reform.
