Abstract:

Tato bakalářská práce se zabývá institutem promlčením jako okolností způsobující zánik trestnosti. Úvod je věnován samotnému pojmu trestní odpovědnosti, historickému vývoji, významu a důvodům existence promlčení. Hlavní část je věnována podrobné analýze tohoto institutu - promlčecím dobám a jejich počítání, důvodům pro stavění a přerušení těchto dob, vyloučení z promlčení a porovnání s úpravou v jiných státech, charakteristikou institutu promlčení v občanskoprávních a obchodněprávních vztazích. Na závěr je zhodnocení a návrhy de lege ferenda.

Abstract:

Bachelor thesis deals with limitation of time as circumstance causative conclusion of liability institution. The introduction is dedicated to the term of criminal responsibility, historical evolution, the importance and reasons for the existence of limitation. Main part is dedicated to the detail analysis of the institution, time limitations and counting, reasons for suspension and interruption of these periods, exclusion of prescription and adjustment in comparison with other states, characteristic of the institute of limitation in civil and commercial relationships. There is an assessment and proposal de lege ferenda at the conclusion.
