V diplomové práci se smluvní pokutou zabývám zejména z pohledu obchodního práva. Pouze stručně je vyjadřuji k obecné problematice smluvní pokuty a zaměřuji se stěžejně na otázku nalézání mezí smluvní svobody stran u smluvní pokuty a to nejen ve fázi jejího sjednávání, ale i při výkonu práva z této smluvní pokuty, resp. při jejím vymáhání. Abstract:
In my diploma paper I deal with the judicial process related to finding the limits of freedom of contract regarding the process of negotiation and enforcement of contractual penalty in commercial relations. I call attention to the facts which in actual situations may have impact on considering the contractual penalty as valid or worth legal protection.
