Rent and Lease

Abstract:

Má závěrečná práce se týká problematiky nájmu a pachtu. Tyto právní instituty jsou nástrojem pro legální užívání cizího majetku a v případě pachtu také požívání užitků z něj plynoucích. V úvodní kapitole své závěrečné práce se budu věnovat širším souvislostem s problematikou související, jako je definice věci či právnímu vztahu a jeho uzavření, změně či zrušení. Posléze se však již dostanu k podstatě závěrečné práce, a to samotnému nájmu a pachtu, jejich rozdělení dle situace a využití a potížím, které jsou spojeny s těmito právními instituty a jejich aplikací.

Abstract:

In my thesis I will discuss rent and lease. These legal institutes are a tool for the legal use of other's property and, in the case of ususfructuary lease, also the enjoyment of the benefits deriving from it. In the introductory chapter of my thesis, I will address the broader context of related issues, such as the definition of the thing or legal relationship and its conclusion, change or cancellation. Then I will get to the essence of thesis, namely the rent and the usufructuary lease itself, their division according to the situation and use and the difficulties associated with these legal institutes and their application.
