Abstract:

Domácí násilí je v současnosti velice diskutovaným problémem. V Parlamentu ČR jsou projednávány, a naštěstí některé i přijímány, zákony, které by mohly pomoci zlepšit postavení jeho obětí. Ačkoli pod pojem domácí násilí řadíme násilí páchané jakýmkoli rodinným příslušníkem na jakémkoli jiném členovi rodiny, toto pojetí by bylo příliš široké pro rozsah diplomové práce a tudíž tato práce pojednává pouze o partnerském násilí. A protože u tohoto typu násilí převládá agrese ze strany muže vůči partnerce, zabývám se pouze touto situací, aniž bych však popírala existenci opačného případu. Část práce je věnována mezinárodnímu zakotvení ochrany žen před domácím násilím a také neoddiskutovatelně významné činnosti neziskových organizací. Domácí násilí je komplexní problém, který vyžaduje, i v rámci práva, interdisciplinární přístup. Zasahuje do práva občanského, rodinného, přestupkového a policejního, a trestní právo by mělo nastoupit až za situace, kdy problém není možné řešit některým z jejich institutů. Co se týká trestního práva, je zde rozebrán, mezi jinými, přínos novely trestního zákona zakotvující trestnost týrání osoby žijící ve společně obývaném bytě nebo domě, a potom i problematické tzv. dispoziční právo oběti. V případech domácího násilí hraje důležitou roli policie. V práci je proto detailně rozebrána její činnost, přičemž důraz je kladen na aktivity skupiny Domácí násilí Služby kriminální policie a vyšetřování Městského ředitelství Policie ČR Brno. Co může přinést připravovaný zákon o domácím násilí, třeba i na základě zkušeností s obdobnou úpravou v zahraničí, je potom také zhodnoceno v této práci.

Abstract:

Domestic violence is a topic very debated in the Czech Republic during a few last years. The objective of my diploma thesis is to collect as much as possible information about this topic to be able to evaluate the progress the czech law has reached and suggest what kind of additional change is necessary. Within this thesis it is practically impossible to look at all the forms of the domestic violence and that is why this work concentrates only on domestic violence where the victims are women. Domestic violence is a very comprehensive topic and therefore the definition itself must be explained as well as the general questions, forms, psychological aspects and victimology. There are some international instruments, e. g. within the United Nations and the Council of Europe, for the protection of the right of women to be protected from (domestic) violence. For this purpose, several treaties, recommendations and other activities must be mentioned. This thesis deals especially with the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), General Recommendation No. 19 of the CEDAW Committee about violence against women and activities of the Special Rapporteur on violence against women, its causes and consequences and some recommendations of the Council of Europe. Activities of the NGOs in the Czech Republic are mentioned because they have played a significant role by impact on the adoption of some kind of progressive regulation in recent years, they support educational programmes, provide psychological, social and legal aid for the victims of domestic violence. Besides the protection on the level of the criminal law, it is necessary to provide the victims of domestic violence with the protection on the level of civil, family and administrative law. These possibilities are mentioned in this thesis. Regarding the criminal law, the development of adopting the new provision of article 215a of the Penal Code, penalizing the maltreatment of the close person and the person living in a common house or flat, and the final adoption of this provision, are properly discussed in this thesis, as well as a very controversial provision in the Code of Criminal Procedure in article 163, which permits to prosecute the agressor only with the approval of his victim if he is the close person in relation to her. The role of police, emphatically the activities of the newly established police group dealing especially only with cases of domestic violence in Brno which may be a convenient model of the police role in the problem of domestic violence. This thesis deals also with the proposal statute which should change several provisions of various acts of law, especially amending the police law and the Code of Civil Procedure.
