Consular law in a practical scope

Abstract:

The Dissertation applies consular law and the institution of consular protection in practice on the example of ensuring the consular agenda and protection of citizens (of the Slovak Republic, the Czech Republic, Great Britain, the United States of America and India) temporarily or permanently residing in Ukraine before and after the beginning of the Russian invasion of Ukraine in February 2022. The Dissertation approaches consular law and its origins. It is based on the Vienna Convention on Consular Relations from 1963, as well as on the Directive on consular protection of unrepresented EU citizens from 2015 and the national concepts of consular protection of the above-mentioned countries. It analyses the system of consular protection of several countries, including the consular protection provided to citizens of Ukraine during their escape and seeking refuge in the Slovak Republic during the mass influx of refugees from Ukraine before the war in their country. The Dissertation also describes the events that resulted in the Russian Federation's armed attack of Ukraine, which aims to bring closer the circumstances under which consular protection is currently provided. The research part of the Dissertation analyses the specific consular protection provided and its system to citizens of the above-mentioned countries under the above-mentioned circumstances, in particular: the extent of the provided consular agenda, the impact of martial law and war conditions on the execution of the agenda and the protection provided, as well as the application of the directive on the protection of unrepresented EU citizens.

Abstract:

Cieľom práce je aplikovať konzulárne právo a inštitút konzulárnej ochrany do praxe na príklade zabezpečenia konzulárnej agendy a ochrany občanom (Slovenskej republiky, Českej republiky, Veľkej Británie, Spojených štátov amerických a Indie) dočasne alebo trvalo prebývajúcim v Ukrajine v čase pred a po začatí ruskej invázie Ukrajiny vo februári roku 2022. Práca približuje konzulárne právo a jeho pôvodu. Ukotvuje sa o Viedenský dohovor o konzulárnych stykoch z roku 1963, ako aj o Smernicu o konzulárnej ochrane nezastúpených občanov EÚ z roku 2015 a národné koncepcie konzulárnej ochrany vyššie spomenutých krajín. Analyzuje systém konzulárnej ochrany viacerých krajín, vrátane poskytnutej konzulárnej ochrany občanom Ukrajiny počas ich úteku a hľadania útočiska v Slovenskej republike počas masových prílivov utečencov z Ukrajiny pred vojnou v ich krajine. Práca rovnako popisuje udalosti, ktoré vyústili v ozbrojený úrok Ruskej federácie na Ukrajinu, čo má za cieľ priblížiť okolnosti za akých je konzulárna ochrana aktuálne poskytovaná. Výskumná časť práce analyzuje konkrétnu poskytnutú konzulárnu ochranu a jej systém občanom vyššie spomenutých krajín za vyššie spomenutých okolností, najmä teda rozsah poskytnutej konzulárnej agendy, vplyv stanného práva a vojnových podmienok na výkon agendy a poskytovanú ochranu, ako aj aplikácie smernice o ochrane nezastúpených občanov EÚ.
