Criminological characteristics and typical traces of theft

Abstract:

Majetkovou trestnou činnost považuji za závažný společenský problém. Jedním z nejčastějších druhů majetkové trestné činnosti jsou krádeže. Má bakalářská práce je tak věnována trestnému činu krádeže a jeho typickým stopám. Ve své práci si kladu za cíl seznámit čtenáře se základními pojmy, které souvisejí se zpracovávaným tématem, vysvětlit jednotlivé formy trestného činu krádeže a poskytnout ucelený přehled typických stop tohoto trestného činu, jejich zajišťování a dokumentaci. V této souvislosti vycházím nejen z platné právní úpravy, odborné literatury, ale i ze svých vlastních zkušeností coby příslušníka Policie ČR. Práce je rozčleněna na čtyři hlavní části. První část práce je zaměřena na vysvětlení pojmu krádež a s tím související otázky, dále na seznámení čtenáře s jednotlivými formami krádeže, s typickými pachateli krádeže a předměty útoku. Součástí prvé části je rovněž nastínění vývoje trestné činnosti páchané formou krádeže za období od roku 2013 do současnosti, vycházeje ze statistik Policie ČR. Druhá část práce objasňuje samotnou podstatu, pojem, druhy a význam stop v kriminalistice a poté se věnuje typickým stopám trestného činu krádeže. Třetí část práce popisuje postup při vyhledávání a zajišťování materiálních stop, kriminalistické dokumentaci, která je využívána při vyšetřování trestného činu krádeže ze strany Policie ČR. A konečně čtvrtá část práce, dle mého názoru stěžejní, se zabývá vybranými druhy krádeže a jejich typickým stopám.

Abstract:

I consider crimes against property a serious social problem. One of the most frequent and common type of offences against property is theft. Therefore, I devoted my bachelor thesis to theft, its typical clues, evidence traces and characteristics. The aim of my work is to get the reader acquainted with basic concepts related to the mentioned topic, explain various forms of crimes of theft and provide a comprehensive overview of typical evidence traces of this crime, their ascertainment, collection, and documentation. In this context, I used not only valid legal regulations and professional literature but, as a member of the Police of the Czech Republic, I also leveraged my own experience with this type of offence. The work is split into four main parts. The first part hereof focuses on explaining the concept of theft and related issues, then on getting the reader acquainted with various types of theft, with typical theft offenders as well as the common objects of their offences. This part also outlines development of crimes committed in the form of theft over the period starting from 2013 to the present based on statistics of the Police of the Czech Republic. The second part of the thesis clarifies the very essence, concept, types and significance of evidence traces in the field of criminology and identifies the most common evidence traces found at theft crime scenes. The third part hereof describes the procedure of searching for and collecting physical clues / evidence traces, and its documentation used in investigations of the crime of theft by the Police of the Czech Republic. And finally the fourth part of my study, which is crucial in my opinion, describes selected types of theft along with their typical evidence traces.
