Justified Usage of a Gun by Officers of Czech Police as a Circumstance Eliminating Criminal Responsibility
Abstract:
Tato práce je zaměřena na institut oprávněného použití zbraně z pohledu trestněprávního. Jejím cílem je dokázat, že tato okolnost vylučující protiprávnost má své svébytné aspekty a problémy, jenž doprovází její aplikaci v praxi. Cílem je tyto problémy označit a navrhnout nová řešení.
Abstract:
This thesis is aimed on the justified usage of a gun by Czech police officers in the wiev of Czech Criminal Code. Although the legitimate usage of a gun is based on two circumstances eliminating criminal responsibility - self-defence and exigency and takes from them the principles which makes it legitimated, it has distinct features and is not only their derivation of them.
