Specifics of Intangibles in the Transfer Pricing Area

Abstract:

Tato diplomová práce se zaměřuje na ucelené představení specifických aspektů nehmotného majetku v oblasti transferových cen. Volba tématu vychází ze stále narůstajícího zájmu daňových správ o tuto oblast, neboť přítomnost nehmotného majetku může mít významný vliv na výši transferových cen účtovaných v rámci skupin podniků a tedy i na daňový základ poplatníků. Taktéž absence komplexního shrnutí této problematiky v českých odborných publikacích byla důvodem pro zpracování tohoto tématu. Cílem této diplomové práce je poskytnutí metodické příručky jak pro odbornou, tak pro širokou veřejnost, na základě které bude možné postupovat pro účely správné identifikace nehmotného majetku ve skupinových transakcích, pro účely stanovení hodnoty takového majetku a případně pro následnou alokaci zisku generovaného tímto nehmotným majetkem na oprávněné společnosti skupiny.

Abstract:

This Master's Thesis focuses on the presentation of a comprehensive overview of specific aspects of intangibles in the area of transfer pricing. Choice of this theme has been influenced by the growing interest of tax administrations in this area, since the presence of an intangible in controlled transaction may have a significant impact on the amount of transfer prices charged within the group of enterprises and thus also on the tax base of taxpayers. As well, the absence of any comprehensive summary of this issue in Czech scientific publications contributed to the choice of this theme. The aim of this Master's Thesis is to provide a methodological guide for professionals as well as for general public. Following such guidance should lead to proper identification of an intangible property in controlled transactions and of its value, as well as to the proper allocation of profits generated by such intangible property to the entitled entities of the group.
