The Economics of Rebates as a Concerned Competition Practice in the European Union and the United States of America

Abstract:

Diplomová práce identifikuje ekonomické dopady rabatů jako jedné z forem cenové diskriminace při jejich použití firmou v dominantním postavení. Zvláštní důraz je pak věnován věrnostním rabatům, jakožto speciální kategorie. Práce se snaží zjistit, zda soutěžní autority a soudy rozhodují užití rabatů jakožto protisoutěžní samo o sobě. Dále práce zkoumá, zda tzv. test stejně výkonného soutěžitele je vhodným prostředkem k rozhodování o tom, zda rabaty mohou vyloučit stejně výkonného soutěžitele a kriticky zkoumá jeho uplatnění v praxi. Nakonec práce srovnává přístupy k posuzování rabatů ze strany příslušných soutěžních orgánů ve Spojených státech a Evropské unii. Za účelem splnění těchto cílů se práce snaží zodpovědět, zda rabaty mají pozitivní dopad na hospodářskou soutěž nebo obecně narušují soutěžní prostředí na úkor spotřebitelů a zdali je přístup k posuzování rabatů ve Spojených státech méně přísný než je tomu v Evropské unii.

Abstract:

This diploma thesis identifies economic impacts of rebates as a form of price discrimination by a dominant firm with special emphasis to loyalty rebates. It tries to establish whether competition authorities and courts deciding competition cases shall consider rebates as anticompetitive per se. Next the thesis examines whether a so-called as efficient competitor test is an appropriate measure for deciding whether rebates can exclude equally efficient competitor and deals with problems of its application in practice. Lastly, the thesis compares approaches to assessment of rebates by the relevant US and EU authorities. In order to fulfil these aims the thesis tries to answer whether rebates have positive impacts on competition or generally hamper competition to detriment of consumers and whether is the approach to rebates less stringent in the USA than in the EU.
