Reform of public administration in the First Czechoslovak Republic.

Abstract:

Bakalářská práce je zaměřena na komplexní analýzu problematiky správního práva v první československé republice s presahem do rovin právního, historického, společenského a politického vývoje. Dílčí cíle zahrnují identifikaci a analýzu premis vzniku správního systému v ČSR, dále faktické podložení interdependence mezi správou a národnostními otázkami a jejich dopad na legislativní politiku státu, v neposlední řadě také porovnání jednotlivých systému a posouzení jejich vlivu na chod společnosti a stabilitu státu.. Při vypracování dané práce byl kladen důraz na prameny normativního charakteru, pro zachování maximální možné míry objektivity byly také použity jak historické, tak i současné interpretační prameny, zaměřující se na problematiku správního práva v referenčním období. Přínos práce spočívá v jednoznačném vymezení souvztažnosti fungování veřejné správy s politikou státu a v argumentaci podporující tezi provázaností veřejné správy s národnostní problematikou. Koncepce práce činí z ní relevantní zdroj informací nejen pro zájemce o vývoj správního práva mezi válkami, ale též pro širší cílovou skupinu, která v ní spatří dobovou deskripci veřejného prostoru z jiného úhlu, než v jakém je reflektován v konvenčních historických dílech.

Abstract:

The thesis in question is focused on the complex analysis of the dimension of administrative law during the First Czechoslovak Republic (ČSR) as well as extending the analysis further into theissues of legal, historical, social and political development. The principal goals of the thesis are distributed between the effort to identify and examine the premises that led to the formation of the administrative system in ČSR and to present factual suport on behalf of the interdependence between administration and ethnical composition, including its effect on the legislative policy of the state. Finally, the thesis aims to present a tenable comparison of individual administrative systems and their direct impact on the functioning of the society and the stability of the state. The thesis has been elaborated using mainly sources of normative character. Interpretational works from both historical and current writers, who centered on the issues of the administrative law in the reference period, have been used for the purpose of greater objectivity. The thesis contributes to a clear definition of the correlation between the functioning of the administrative system and the state-policy as well as in the argumentation supporting the hypothesis of the cohesion between public administration and ethnical distribution within the state. The concept of the thesis makes it relevant not only for specialists seeking to broaden their knowledge on the subject of administrative law, but also to a broader public that will find a unique description of the target period?s public issues, which are explained in a manner that differs from the conventional historical works.
