Abstract:

Diplomová práce popisuje a vystihuje vývoj pojištění odpovědnosti z provozu vozidla včetně ostatních změn a úprav v průběhu celého vývoje tohoto pojištění. Důležitým poznatkem této práce je, že hlavní body od počátku vzniku „povinného ručení“ zůstaly stejné po celou dobu jejího trvání. Největší změny zaznamenaly výše pojistných částek, které reagovaly na potřeby konkrétní doby a dále také zákonná úprava, která prodělala několik důležitých a významných změn. Dále pro soulad mezi jednotlivými členskými státy jistě přispěla i čtvrtá motorová směrnice, která by měla zjednodušit postupy při nehodách pro poškozené strany, jež mají nárok na náhradu za škody nebo zranění v důsledku dopravní nehody v členském státě jiném než členském státě trvalého bydliště poškozené strany, jež byly způsobeny provozem dopravních prostředků pojištěných a normálně registrovaných v členském státě.

Abstract:

The rgraduate thesis describes the development of legal direction connected to the statute regulating vehicle insurance including additional changes and improvements during the entire period of development of this insurance. The most important proclamation of the thesis is the fact that the core pillars of mandatory vehicle insurance remained the same over the term of its effect. The insured amounts and the legal customization, however, went through the most significant changes due to the need of reaction to the demands of the specific period. In order to coordinate the law among the member countries, there was a fourth motor vehicle statute, which should simplify the processes for the faultless participants during the accidents, who have a right to demand reimbursement (regarding damage to assets or health) as a result of an accident on a territory of a member country other than the member country of the permanent residence of the faultless accident participant, which were caused during normal traffic of motor vehicles of the insured a registered residents of that member country.
