Abstract:

Diplomová práce se zabývá anonymním prostředím kyberprostoru nazývaného DarkNets a s tímto prostředím spojenou problematikou zajišťování důkazů důležitých pro trestní řízení z pohledu orgánu činného v trestním řízení Celní správy České republiky, kdy zejména toto prostředí umožňuje prodej omamných a psychotropních látek. Snahou autora je vymezení a definování pojmu DarkNets a popsat s tímto prostředím spojený proces zajišťování důkazů, neboť tato problematika není v současné právní legislativě České republiky nijak upravena. Diplomová práce je rozdělena do čtyř kapitol, kdy první dvě kapitoly tvoří teoretickou část práce a třetí a čtvrtá kapitola jsou součástí praktické části. V první kapitole jsou vymezeny základní pojmy související s kyberkriminalitou a kyberprostorem. Značná část kapitoly se věnuje také problematice elektronických tržišť tzv. Dark Market Places v prostředí DarkNets a anonymizačními prostředky, které jsou zde využívány. Ve druhé kapitole je popsána úloha a činnosti orgánů činných v trestním řízení, konkrétně Celní správy a dále jsou zde definovány postupy, rizika a jejich eliminace při zajišťování a dokumentování důkazů důležitých pro trestní řízení z prostředí DarkNets. Ve třetí kapitole je analyzována řešená problematika za využití komparace dvou případových studií. Závěrečná kapitola se zaměřuje na návrhy a doporučení pro zlepšení současné situace. Cílem diplomové práce je analyzovat současnou právní úpravu, postupy, taktika a zkušenosti vybraných národních i mezinárodních orgánů činných v trestním řízení, včetně Celní správy České republiky a navrhnout postupy směřující k úspěšnému odhalování a předcházení trestné činnosti páchané v pseudo-anonymním prostředí DarkNets, specificky pak na Dark Market Places.

Abstract:

The thesis deals with the anonymous environment of the cyberspace called DarkNets and the related issue of securing evidence important for criminal proceedings from the perspective of the law enforcement agency of the Customs Administration of the Czech Republic, where in particular this environment enables the sale of narcotic drugs and psychotropic substances. The author seeks to define and define the term DarkNets and describe the process of securing evidence related to this environment, as this issue is not regulated in the current legal legislation of the Czech Republic. The thesis is divided into four chapters, where the first two chapters form the theoretical part of the thesis and the third and fourth chapters are part of the practical part. The first chapter defines the basic concepts related to cybercrime and cyberspace. A significant part of the chapter is also devoted to the issue of electronic marketplaces called Dark Market Places in the DarkNets environment and the anonymization means that are used there. The second chapter describes the role and activities of law enforcement agencies, specifically the Customs Administration, and defines the procedures, risks and their elimination in securing and documenting evidence relevant to criminal proceedings from the DarkNets environment. The third chapter analyses the issue at hand using a comparison of two case studies. The final chapter focuses on suggestions and recommendations for improving the current situation. The aim of the thesis is to analyse the current legislation, procedures, tactics and experiences of selected national and international law enforcement agencies, including the Customs Administration of the Czech Republic, and to propose procedures aimed at the successful detection and prevention of crimes committed in the pseudo-anonymous DarkNets environment, specifically on Dark Market Places.
