Process-practical aspects of the institute of the cooperative accused person and a comparison with the Slovak legislation

Abstract:

Institut spolupracujícího obviněného podle § 178a trestního řádu je v současné době procesní úpravou tzv. spolupracující osoby. Jedná se o problematiku, s níž se stále pojí dílčí aplikační problémy v české trestní praxi. Z tohoto důvodu se autor rozhodl pokračovat ve zpracovávání tohoto tématu i ve své rigorózní práci, a proto se tato rigorózní práce ve svých 7 kapitolách včetně úvah de lege ferenda věnuje vybraným aplikačním problémům institutu a komparaci s právní úpravou Slovenské republiky. První kapitola rigorózní práce se věnuje jednak úvodním poznámkám institutu, jednak dalším obecným tématům provázejících aplikaci institutu spolupracujícího obviněného. Pro účely jejího zpracování se autor dále věnuje podmínkám podání návrhu státního zástupce na upuštění od potrestání spolupracujícího obviněného podle § 178a odst. 2 trestního řádu, jemuž v publikační činnosti není věnována téměř žádná pozornost. Podle § 178a odst. 3 trestního řádu se koná výslech (spolupracujícího) obviněného; tento nezbytný předpoklad označení za spolupracujícího obviněného autor považuje za důležitý okamžik v procesu označování. Za přínosné trestní praxi považuje autor i následující dvě kapitoly rigorózní práce, jejichž předmětem je výklad problematiky navázané na činnost soudu a obhájce spolupracujícího obviněného; jedná o důležitý protiklad ostatním částem práce, pro něž je typický výklad spíše z pohledu státního zástupce. Zaměření jednotlivých kapitol tak respektuje rozdílné procesní role jednotlivých subjektů trestního řízení. Druhou stěžejní částí autorem předkládané rigorózní práce je komparace procesního institutu spolupracujícího obviněného podle § 178a trestního řádu s právní úpravou Slovenské republiky, která se uzákoněním institutu tzv. spolupracující osoby rovněž vyznačuje, ačkoliv v jiné procesní formě. Rozklíčování slovenské právní úpravy tak je součástí šesté kapitoly. Ve všech tématech s výjimkou slovenské trestní praxe se odráží praktické osobní zkušenosti autora s aplikací institutu.

Abstract:

The institute of the cooperative accused person according to § 178a of the Criminal Procedure Code is currently a procedural treatment of the so-called cooperative person. It is an issue that still faces partial application problems in Czech criminal practice. For this reason, the author decided to continue to pursue this topic in his rigorosum thesis, and therefore, the rigorosum thesis deals with the selected application problems of the institute and with a comparison of the legislation of the Slovak Republic in seven chapters of his rigorosum thesis, including de lege ferenda chapter. The first chapter of the rigorosum thesis is devoted to the introductory notes of the institute and to other general themes accompanying the application of the institute of the cooperative accused person. For the purposes of its elaboration, the author also deals with the conditions of state attorney's proposal to waive the punishment of a cooperative accused person according to § 178a (2) of the Criminal Procedure Code, to which almost no attention is paid in the publication activity. According to § 178a (3) of the Code of Criminal Procedure, the interrogation of a (cooperative) accused person is held; the author considers this prerequisite for the designation of the cooperative accused person as an important moment in the cooperative accused person's designation process. The author also regards the following two chapters of a rigorosum thesis, which deal with the interpretation of the issue related to the activity of the court and the cooperative accused person's defence counsel, as important for the beneficial criminal practice. This is an important contrast to other parts of the rigorosum thesis, for which a typical interpretation is rather from the point of view of a state attorney. The focus of the individual chapters therefore respects the different procedural roles of the individual subjects of criminal proceedings. The second key part of the thesis is the comparison of the procedural institute of the cooperative accused person according to § 178a of the Criminal Procedure Code with the legal regulation of the Slovak Republic, which is also characterized by the law of the so-called co-operating person, although in another procedural form. The narrative of the Slovak legal regulation is thus the part of the sixth chapter. In all topics, except for the Slovak criminal practice, the author reflects his personal experience with the application of the institute.
