Anotácia:

Tato diplomová práce se zabývá problematikou těch mezinárodních smluv, které uzavírá Evropská unie se třetími, tj. nečlenskými státy. Diplomová práce v obecné rovině stručně vymezuje základní charakteristiku a typologii mezinárodních smluv. Stěžejní části této práce potom tvoří kapitoly věnované postavení mezinárodních smluv v právu Evropské unie, dále analýze způsobilosti EU jako mezinárodní organizace k uzavírání mezinárodních smluv, vymezení a rozdělení mezinárodních smluv v oblasti vnějších vztahů Unie a v neposlední řadě i otázce automatické závaznosti mezinárodních smluv pro členské státy v případě, kdy nejsou jejich smluvní stranou. Všechny výše zmíněné oblasti zájmu této diplomové práce jsou hodnoceny zejména ve vztahu k Lisabonské smlouvě a ke změnám, jež přinesl její vstup v platnost.

Abstract:

This master thesis deals with the issue of the international treaties which are concluded by the EU with third, i.e. non-member states. The thesis briefly defines the characteristics and the typology of the international treaties in general. The main parts of the thesis are devoted to the status of the international treaties in the EU law, furthermore to the analysis of the capacity of the EU as an international organisation to conclude international treaties, to the defining and division of the international treaties concluded in the area of external relations of the Union and last but not least to the question of the binding force of the treaties for EU member states when they are not parties to the treaty. All of the above mentioned areas of interest of this master thesis are evaluated especially in relation to the Lisbon Treaty and to the changes which were made by its entry into force.
