Abstract:

The first part examines the consequences of restrictions in providing Internet betting not only within the European Union but also from the global point of view. The legal grounds for monopolizing national betting markets are typically justified in these countries as a protection of population and public order. The topic is considered, for the reason of clarification, not only from the legal point but also as a technical, social and economic issue. The third chapter deals with legal regulations of Community law, principles being referred to by operators oppressed by the member states. The main stress is laid on legal regulations concerning the topis in the Czech legislation. The conclusions of the European Court of Justice, especially the Gambeli case, illustrate the attitude of this Union body towards settling disputes solved by national courts. However, in practice the ECJs conclusions are construed, due to a very lose interpretation, in a totally different way by the litigant parties. The closing part presents all the basic legislation governing the subject matter.
