Administrative Law Regulation of Prostitution

Abstract:

Prostituce je velkým problémem dnešní společnosti. Tato diplomová práce se zabývá různými druhy právní regulace prostituce, zejména správněprávní regulací prostituce. Hlavním cílem této práce je provést analýzu správněprávní regulace prostituce v České republice a v závěru této práce ji vyhodnotit. V úvodu práce se autor pokouší vymezit předmět právní regulace prostituce a podává stručný přehled těch nejvýznamnějších projevů prostituce. Vedle vnitrostátní právní regulace prostituce se tato práce věnuje též mezinárodněprávní a unijní právní úpravě regulace prostituce a jejích projevů. Závěr této práce obsahuje hodnocení předcházející analýzy správněprávní regulace prostituce v České republice (de lege lata) a autorovy úvahy (de lege ferenda), které vychází z výhod a nevýhod tří hlavních legislativních přístupů k prostituci, historických zkušeností a také autorovy zkušenosti s veřejnou správou.

Abstract:

Prostitution is a considerable problem of the current society. This thesis focuses on various sorts of the legal regulation of prostitution, especially the administrative law regulation of prostitution. The aim of this thesis is to analyze the administrative law regulation of prostitution in the Czech Republic and to assess this analysis in the conclusion of this thesis. At the beginning, there are an attempt to define the object of the legal regulation of prostitution and a short overview of the most significant effects of prostitution. Besides the National legal regulation of prostitution, this thesis also includes a short excursus into the International and European Union law regulation of prostitution and its effects. The last part of this thesis includes the assessment of the previous analysis of the administrative law regulation of prostitution in the Czech Republic (de lege lata) and some author´s legal considerations (de lege ferenda) based on the advantages and disadvantages of three main legislative approaches to prostitution, the historical experiences, as well as the author´s experience with the public administration.
