Long-term Attendance Allowance - new sickness insurance benefit

Abstract:

Diplomová práce je zaměřena na oblast nemocenského pojištění, upraveného zákonem č. 187/2006 Sb., o nemocenském pojištění, ve znění pozdějších předpisů. Pro svou diplomovou práci jsem si vybrala novou dávku nemocenského pojištění, dlouhodobé ošetřovné, které je zavedeno od 1. června 2018. Cílem práce je její objasnění a porovnání platná právní úpravy s novými doporučeními a úpravami. V teoretické části se věnuji postavení systému nemocenského pojištění v sociálním zabezpečení, jeho legislativní úpravě, popisu jednotlivých nemocenských dávek a legislativním podmínkám čerpání nové dávky dlouhodobého ošetřovného. V aplikační části provedu zpracování jednotlivých možných situací při čerpání dávky dlouhodobého ošetřovného. Na základě statistických údajů objasním jednotlivé aspekty čerpání dávky podle platné legislativy, analýzu a možnosti zneužívání čerpání dávky. V závěru práce provedu shrnutí všech zjištěných poznatků.

Abstract:

This diploma thesis is focused on the sickness insurance as regulated by the Act No. 187/2006 Coll., on sickness insurance, as amended. The thesis is aiming specifically on new benefit in the sickness insurance - long-term attendance allowance which is effective as of 1st June 2018. The intention is to clarify it and compare the current legislation with new recommendations and regulations. The position of sickness insurance in the social security system is discussed together with its legislation, specific benefits provide under sickness insurance and legislation conditions for the new financial benefit of the long-term attendance allowance in the theoretical part. The different situation applicable for financial benefit of the long-term attendance allowance are evaluated in the practical part of the thesis. The particular aspects of the long-term attendance allowance are clarified and analysed together with potential abuse based on statistical data. All findings are summarised in the conclusion part.
