EU Law: The Reason for a Change in International Arbitration?

Abstract:

Cílem této diplomové práce je analyzovat společné body rozhodčího řízení (arbitráže) a evropského práva. S ohledem na četná rozhodnutí Evropského soudního dvora se vzájemný vztah mezi nimi začíná velmi vyostřovat. Nejprve se autorka v práci zabývá oblastmi, kde se arbitráž a evropské právo střetávají nebo mohou střetnout. V následujících kapitolách je diskutována aplikace evropského práva v samotném rozhodčím řízení, a to od počátku až do fáze přezkumu národními soudy. Pozornost je rovněž věnována právu rozhodců nebo jejich odmítnutí využít předběžnou otázku u Evropského soudního dvora. Na závěr se práce soustředí na interpretaci a budoucnost rozhodčí výjimky v Nařízení Rady (ES) č. 44/2001 o příslušnosti a uznávání a výkonu soudních rozhodnutí v občanských a obchodních věcech.

Abstract:

This thesis deals with the most important points of contact between arbitration and EU law. In the view of many decisions granted by Court of Justice of European Union, the interface between the two slowly takes shape. The author first determines those areas where arbitration and EU law meet or may possibly meet. In the following chapters it first discusses the application of EU law in arbitration proceedings itself, from the beginning until the stage of review by national courts. The focus is turned on the arbitrators right or denial of thereof to refer the question to the Court of Justice for preliminary ruling. Last but not at least, the thesis deals with the interpretation and the future of arbitration exemption to the Council regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters.
