Author and author’s work - term and function in copyright law

Abstract:

Autor, dílo, autorský zákon, ochrana autorských děl, to jsou v dnešní době diskutované pojmy, proto jsem si pro svou bakalářskou práci vybrala právě téma z oblasti autorského zákona. Často kladenou otázkou je, zda jsou autor, jeho dílo a následná autorská práva dostatečně chráněni. Tato práce ve své obecné části analyzuje pojem autorského práva, pojem autora a jeho díla, další práva s právy autorskými související. Kolektivní správa práv autorských a práv s autorským právem souvisejících je předmětem další části práce. Co je účelem kolektivní správy, jaká je činnost kolektivního správce. Práce popisuje činnost jednotlivých kolektivních správců autorských děl v České republice, kteří mají oprávnění k této činnosti udělené Ministerstvem kultury: DILIA, OSA, INTERGRAM, OOA-S, GESTOR, OAZA.Cílem práce tedy bylo analyzovat a porovnat činnosti ochranných organizací, zhodnotit do jaké míry a jak účinně plní svoji funkci.

Abstract:

Author, author´s work, copyright law, copyright protection - these are discussed topics at present days, topics on the front burner, therefore I have decided to deal with copyright law in my thesis. There is a question frequently asked - is the author, his work and copyright protected enough, in succesfull rate? This thesis, in its general part, analyzes the term of copyright, the term of the author and his work, the term of other laws related to copyright. Collective management of copyrights and rights related to copyright is the point of practical part of my work. What is the purpose of collective management, what is the activity of collective manager - these are the questions I would like to answer in my thesis. This part of my thesis describes the acitivity of each single collective manager in our country who has an authorisation to execute collective rights management given by the Ministry of Culture: DILIA, OSA, INTERGRAM, OOA-S, GESTOR, OAZA. The target of my work was to analyze and compare activities of collective managers, to say how effectively these organizations work and if they function as a real protection of rights for the authors.
