Critical Anylysis of Leninency - Programme

Abstract:

Tato práce se zabývá programem shovívavosti (tzv. leniency programme). Jedná se o zvláštní prostředek k odhalování horizontálních kartelových dohod pomocí informací poskytnutých samotnými členy tohoto kartelu výměnou za snížení nebo úplné odpuštění sankce. Cílem této práce je popsat vývoj programu a základní sporné otázky jeho koncepce z pohledu teorie i jeho praktické aplikace zejména v rozhodovací činnosti Evropské komise. Klíčovou otázkou se jeví míra efektivity tohoto programu, zejména v závislosti na jednotlivých podmínkách jeho uplatnění a ve vztahu k základním principům práva. K hodnocení této efektivity využívá práce komparativní analýzu jednotlivých vývojových stádií programů Evropské komise, následně pak analýzu rozdílů v konstrukci podmínek k uplatnění programu v některých vybraných zemích. Dále se práce zabývá vztahem k soukromoprávnímu vymáhání práva a k trestněprávním následkům porušení soutěžních pravidel. V závěru předkládám několik úvah de lege ferenda a uzavírám vlastním hodnocením přiměřenosti tohoto nástroje k ochraně hospodářské soutěže.

Abstract:

This diploma thesis deals with a legal framework of leniency programme by detecting of hard-core cartels. Describing the essence and the conditions of use is a prerequisite to adjudicate the programme. We consider the theoretical aspects in comparison with analogous legal institutions e.g. in criminal law. Then we are able to answer the question of admissibility of the essential idea of this programme as a legal institution generally. The thesis provides some presumptions of an effective use at the theoretical level – strict sanctions in the sphere of competition policy - transparency and expectability of decisions, secrecy in the relation between the office and the immunity applicant and last but not the least „attraction“ for potential applicants. At the end of the theoretical part the work focuses on the compliance with basic principles of EC law. The comparative part of the work is introduced by a critical view of the various experience of cartel decisions including cases when the cooperation of the cartelist leads to mitigation but without any single-valued conditions. Then we describe the history of the EC leniency programme. Following the development of the EC leniency can be very inspirational and can explain benefits and shortcomings of particular conditions. However, it is demonstrated by many decisions of European Commission as well as ECJ. The work emphasizes the differences between EC notifications issued in the years 1996, 2002 and 2006 including some statistics as well as some considerations de lege ferenda. Then the comparative analysis of the programme in some selected countries follows. The last part of this work is created by two in manner partial themes - the relation of the leniency programme to the criminalization of anticompetitive practices and to the private enforcement of the competition law. At the end I make some partial conclusions concerning possible harmonisation of the EC leniency programme, its next development and limits. I notify a need of attentive distinguishing between applicants according to a purport of filed information as well.
