Abstract:

Tato diplomová práce se zaměřuje na nájem prostor určených k bydlení. Vzhledem k tomu, že toto téma je velice obsáhlé a rozsah diplomové práce je omezený, je práce zaměřena na to nejhlavnější z této oblasti. Cílem této práce je vysvětlení základních pojmů, jakými jsou například nájem, nájemní smlouva, smluvní strany či koncepce nájemného obecně a hledání hranice mezi nájmem prostor určených k bydlení a fenoménem Airbnb, který se v poslední době velice rozrůstá. S ohledem na současnou situaci spojenou s pandemií COVID–19 práce nezapomněla ani na coronavirová opatření v oblasti nájmu prostoru určeného k bydlení. Práce hledá odpověď, zda je možné chránit byty před tím, aby byly využívány službou Airbnb a jak se vůči této službě velká města brání. Práce je založena na deskriptivní metodě, na základě, které následně dochází k analýze právního textu. Práce vychází z platné právní úpravy, odborné literatury a judikatury.

Abstract:

This diploma thesis focuses on the rental of living space. Due to the fact that this topic is very extensive and the coverage of the diploma thesis is limited, the work is focused on the most important in this area. The aim of this work is to explain the basic concepts such as rent, lease, contracting parties or the concept of rent in general and to find the boundary between the lease of housing and the phenomenon of Airbnb, which has been growing very recently. Given the current situation associated with the COVID-19 pandemic, work has not forgotten about coronavirus measures in this area. The thesis seeks an answer as to whether it is possible to protect flats from being used by the Airbnb service and how large cities defend themselves against this service. The work is based on a descriptive method, on the basis of which there is then an analysis of the legal text. The work is based on valid legislation, literature and case law.
