Pirates in the Web: Social Construction of Piracy in the Documents of Anti-Piracy Organizations

Abstract:

Práce se zabývá činností tří hlavních protipirátských organizací působících v České republice, a to Business Software Alliance, České protipirátské unie a Mezinárodní federace hudebního průmyslu České republiky. Cílem práce je popsat, jakým způsobem tyto organizace vytváří sociální konstrukci pirátství, nový symbolický svět a postavu samotného piráta ve svých materiálech. Internetové pirátství je nahlíženo z pohledu teorie práva, vlastnictví a teorie sociální konstrukce reality. V oblasti sociologie práva jsou zmíněny teorie Maxe Webera, Eugena Ehrlicha, Emile Durkheima a Roscoe Pounda. Teorie vlastnictví popisuje rozpor interpretací vlastnictví v informační společnosti a zmiňuje teorii Waltera Benjamina a Josepha-Pierre Proudhona. V kontextu těchto teorií jsou nahlíženy materiály protipirátských organizací. Jednání samotných sociálních aktérů v kyberprostoru se práce věnuje zejména z hlediska teorie disinhibice. V textu je také zdůrazněna existující mnohost pojetí pirátství ve společnosti a přístup organizací k nim – včetně diskurzivních rozdílů mezi již existujícími a tím, který se protipirátské organizace snaží sociálním aktérům předat. Práce také přináší výsledky relevantních výzkumů věnovaných internetovému pirátství. Reakce protipirátských organizací na zjištěná a představená fakta je v práci reflektována, teoreticky zakotvena a ilustrována.

Abstract:

The thesis is focused on the materials produced by the three most important anti-piracy organization in Czech Republic – Business Software Alliance, Czech Anti-Piracy Union and International Federation of the Phonographic Industry of the Czech Republic. The aim of the thesis is to describe how these organizations create the social construction of piracy, new symbolical world and the character of the pirate. Internet piracy is approached from the view of the theory of law, ownership and the theory of social construction of the reality. The section of the sociology of the law is based on the theories of Max Weber, Eugen Ehrlich, Emile Durkheim a Roscoe Pound. Theory of the ownership describes the discrepancy of the interpretations of the ownership in the information society. It refers to the theory of Walter Benjamin a Joseph-Pierre Proudhon. The activities of the anti-piracy organizations are interpreted in the context of these theories. The behaviour of social actors in cyberspace is reflected from the viewpoint of the disinhibition theory. The thesis emphasizes variety of possible conceptions of piracy in the society and the ways anti-piracy organizations approach them. This includes discoursive differences between already existing conceptions and the new ones the anti-piracy organizations are trying to enforce. The thesis also works with the relevant results of the researches of the Internet piracy. The reaction of the anti-piracy organizations to these facts is reflected, theoretically based and illustrated in this thesis.
