Development Stages of Criminality in the New Criminal Law

Abstract:

Tato práce se zabývá vývojovými stadii trestné činnosti a to přípravou trestného činu a pokusem trestného činu. Tato stadia předcházejí poslednímu a nejzávažnějšímu stadiu, kterým je dokonaný trestný čin. Jedná se o ta stadia trestné činnosti, která jsou trestná. Cílem práce je komplexní zhodnocení trestněprávní úpravy jmenovaných vývojových stadií trestného činu po přijetí nového trestního zákoníku, zákona č. 40/2009 Sbírky, jehož přijetím došlo v právní úpravě vývojových stadií trestného činu k podstatným změnám oproti předchozí právní úpravě. Aktuálnost problematiky daná novou právní úpravou byla primárním důvodem ke zvolení tohoto tématu. Jedním z dalších důvodů byl fakt, že v praxi při kvalifikování trestných činů často dochází k rozdílnosti jednotlivých právních názorů (výkladů) orgánů činných v trestním řízení, které souvisejí s vývojovými stadii trestného činu a které mohou mít zásadní vliv na trestní řízení. Trestná činnost je závažným tématem a diskutovaným fenoménem v České republice i ve světě. Výklad jednotlivých právních norem a zařazení konkrétní činnosti do správného stadia je důležitým aspektem při hodnocení závažnosti činu a má významný dopad na následující trestní řízení. Je proto velmi důležité, aby výklad jednotlivých orgánů činných v trestním řízení byl jednotný. Úvodní část této práce je věnovaná vývojovým stadiím trestné činnosti obecně. Jsou zde popsána specifika vývojových stadií a další činnost, která s těmito úzce souvisí a může vývojovým stadiím předcházet, nebo naopak po těchto následovat. Dále je zde zdůvodněna trestnost vývojových stadií a popsána jejich závažnost. Krátce jsou v této části zmíněny též předčasně dokonané trestné činy. V dalších dvou kapitolách se práce detailněji zabývá přípravou trestného činu a pokusem trestného činu. V úvodu obou kapitol jsou tato vývojová stadia trestné činnosti popsána a charakterizována obecně. V dalších subkapitolách se práce věnuje nezpůsobilé přípravě trestného činu a nezpůsobilému pokusu trestného činu, trestnosti přípravy a pokusu trestného činu, detailně možnosti upuštění od potrestání v případě těchto stadií a v závěru kapitol zániku trestnosti činů při účasti více osob spáchaných ve stadiu přípravy či pokusu trestného činu. Závěr práce je krátce věnován dokonanému trestnému činu a práce je doplněna o vybrané příklady z judikatury.

Abstract:

I have chosen the topic “Development Stages of Criminal Activity in the New Criminal Code” as a topic of my bachelor thesis. I have chosen this topic because on 1 January 2010 there came into effect the new criminal code (the Act No. 40/2009 Coll.), in which substantial changes were made in the relevant provisions dealing with the development stages of a criminal offence. The new criminal code constitutes a certain turning point, namely on the grounds that it is based on the fundamentally changed social, economic and political conditions after the year 1989 and was adopted after almost twenty years of re-codification work. Czech criminal law is a part of the legal system of the Czech Republic, and is considered as a branch of public law. Criminal law defines what antisocial actions constitute criminal offences, imposes punishments and protective measures for the perpetration thereof, as well as sentencing and execution thereof. The purpose of criminal law is to protect interests of society, the constitutional system of the Czech Republic, rights and legitimate interests of natural persons and legal entities from criminal offences, a comprehensive list of which is given in the criminal law norms. In the introductory part of my thesis I attempt to briefly discuss the problem of the development stages of a criminal offence, which are divided into certain phases. These phases are divided into preparation of a criminal offence, an attempted criminal offence, and a perpetrated criminal offence. In many cases it is possible to distinguish the course of the perpetration of a criminal offence, namely from the conception of an idea of perpetrating a criminal offence, to the expression thereof, preparatory actions for the perpetration of a criminal offence, an attempt at implementing the plan to perpetrate a criminal offence, and the perpetration of a criminal offence. Protection of the legal estates requires that actions preceding a perpetrated criminal offence should be criminalised in the defined cases and in certain conditions, although a criminal offence was not perpetrated. In the other parts of my bachelor degree I attempt to deal with the problem of the development stages of criminal activity in greater detail. First, I focus on preparation of a criminal offence and then proceed to an attempted criminal offence and a perpetrated criminal offence. I proceed from the general characteristics of preparation and attempt, to the nature of these development stages, punishability of these offences, possible waiver of punishment in case preparation and attempted criminal offence, and describe the conditions in which this waiver is possible, the cessation of criminal liability if several persons are involved in the perpetration of criminal activity, criminal liability for another perpetrated criminal offence, and a specific form of ineligible preparation and attempt. Marginally I also touch on the problem of a perpetrated criminal offence, whose topic would be sufficient for an independent and more extensive thesis. In conclusion of my bachelor thesis I give examples of the court judicatures concerning the development stages of a criminal offence. It is true that court decisions do not have the precedence meaning in the Czech Republic, as in the Anglo-American legal system, however one cannot claim that they are inconsequential in the application of the law. Although at present the legal bindingness of the judicature is not being spoken of, the term “normative force” is used for indicating the meaning thereof. At the very end of my thesis I give a list of references and all sources from which I drew information and which I used in my final thesis on the topic chosen by me.
