Administrative punishment under the authority of the Czech National Bank

Abstract:

Práce se věnuje správnímu trestání, a to se zaměřením na správní řízení vedená Českou národní bankou. Nejdříve obecně pojednává o správním trestání, o jeho principech a dále o přestupcích, jejich klasifikaci. Dále navazuje text o působnosti České národní banky. Hlavní částí práce je vymezení specifik správního trestání v působnosti jednoho z nejvýznamnějších správního orgánu, České národní banky. Právní úprava je uvedena s ohledem na změnu v legislativě provedenou v roce 2017 a zaměřuje se na odklony v přestupkovém řízení vedeném bankou oproti obecnému přestupkovému řízení. Specificky je dále řešena otázka zveřejňování správních rozhodnutí a následně i otázka toku výnosů z uložených pokut.

Abstract:

The thesis is devoted to administrative punishment, focusing on administrative proceedings conducted by the Czech National Bank. First of all, it generally deals with administrative punishment, its principles and also about offenses and their classification. It also follows the text on the competence of the Czech National Bank. The main part of the thesis is then defining the specifics of administrative punishment in the competence of one of the most important administrative points in the Czech Republic, the Czech National Bank. The legal regulation is introduced especially with regard to the change in legislation made in 2017 and focuses on diversions in the offense proceedings conducted by the Bank compared to the general offense proceedings. Specifically, the issue of disclosure of administrative decisions and the issue of the issue of the flow of proceeds from fines is also addressed.
