Wawing Punishment as a Criminal Law Alternative

Abstract:

Diplomová práce se zabývá institutem upuštění od potrestání a jeho místě v rámci české úpravy trestního práva hmotného i procesního. Autor se na počátku práce zaměřuje na rozbor pojetí trestu a jeho účelu a základních zásad trestního práva, na základě těchto hledisek poté analyzuje rozebíraný institut v současné právní úpravě včetně historického pojetí institutu. V další části se autor věnuje komparaci využití upuštění od potrestání oproti hmotněprávním a procesněprávním alternativám a také exkursu do zahraniční právní úpravy.

Abstract:

This diploma thesis deals with the institute of criminal law known as waive of punishment and its place within the Czech substantive and procedural criminal law. At the beginning, the author focuses on the concept and purpose of punishment as well as the fundamental principles of criminal law. Based on these points of view, the author subsequently analyses the abovementioned institute in terms of the current legal regulation with the inclusion of the historical development concept of the institute. The following section draws a comparison between the usage of waive of punishment against the substantive and procedural alternatives. Significant attention is also paid to the insight into the foreign legal regulation.
