Exemptions from the Charter of Fundamental Rights of the European Union

Anotácia:

Předmětem této diplomové práce je Listina základních práv Evropské unie, která se, po vstupu tzv. Lisabonské smlouvy v platnost, stala právně závaznou pro všechny členské státy Evropské unie. Hypotéza této práce uvádí, že Listina základních lidských práv Evropské unie může ohrozit suverenitu členských států Evropské unie. Tato hypotéza bude testována na případech tří členských států Evropské unie, které si z Listiny základních lidských práv Evropské unie vymohly výjimky, můžeme tedy předpokládat, že mají důvod se dopadů legální závaznosti Listiny obávat. Cílem této práce je také objasnit, z jakých konkrétních důvodů byly tyto výjimky vyjednány, zda tyto důvody odpovídaly oficiálním odůvodněním, kteří aktéři na vyjednání trvali a jakým způsobem vyjednání výjimek probíhalo.

Abstract:

The main objective of this thesis is the Charter of Fundamental Rights of the European Union which became, following the pass of the Lisbon Treaty, legally binding for all member states of the EU. The hypothesis of this thesis states that the Charter of Fundamental Rights of the European Union can, in fact, jeopardize the sovereignty of the member states. This hypothesis will be tested on the case of three EU member states which managed to achieve exemptions from the Charter. We can, therefore, assume that these states do have a reason to feel anxious about the legal consequences of the Charter. Furthermore, this thesis aims to clarify the actual reasons for negotiating these exemptions, whether these reasons converged with the official rhetorics, what actors took the uncompromising positions and what dynamics the exemption negotiations actually had.
